1. Acceptance of Terms

By accessing or using the website of Travel With Eshu ("we", "our", "us"), or by booking any travel services through us, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.

2. Booking and Payment

All bookings are subject to availability. A non-refundable deposit is required at the time of booking to confirm your reservation. The deposit amount varies depending on the type of service and will be communicated to you at the time of booking. The balance payment must be completed before the commencement of services, as per the schedule provided.

We accept payments via bank transfer, UPI, credit/debit cards, and cash. All payments must be made in Indian Rupees (INR) unless otherwise agreed.

3. Cancellation and Refund Policy

3.1 Cancellation by Customer

• Cancellations made 30 days or more before the start date: 80% refund (excluding deposit)
• Cancellations made 15-29 days before the start date: 50% refund
• Cancellations made 7-14 days before the start date: 25% refund
• Cancellations made less than 7 days before the start date: No refund
• No-shows: No refund

3.2 Cancellation by Travel With Eshu

We reserve the right to cancel a booking due to unforeseen circumstances such as natural disasters, political unrest, or any other force majeure event. In such cases, we will offer you a full refund or the option to reschedule your travel, subject to availability.

4. Changes to Itinerary

We reserve the right to make alterations to the itinerary due to weather conditions, road closures, government restrictions, or any other circumstances beyond our control. We will make every effort to provide comparable alternatives. Any additional costs incurred due to such changes will be borne by the customer unless the change is initiated by us.

5. Travel Documents and Requirements

It is your responsibility to ensure that you have valid travel documents including passports, visas, permits (such as Char Dham Yatra registration), and any other required documentation. Travel With Eshu is not liable for any loss or expense incurred due to failure to obtain or present proper documentation.

6. Health and Medical Conditions

Many of our tours operate at high altitudes (up to 3,583 meters at Kedarnath). It is your responsibility to consult with a physician before booking any tour, especially if you have any pre-existing medical conditions. We recommend purchasing comprehensive travel insurance that covers medical emergencies, evacuation, and trip cancellation.

7. Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance that covers trip cancellation, medical expenses, emergency evacuation, loss of baggage, and other potential risks. Travel With Eshu is not responsible for any costs arising from unforeseen events that could have been covered by insurance.

8. Liability

Travel With Eshu acts as an intermediary between you and various service providers (hotels, transport operators, activity providers, etc.). While we carefully select our partners, we are not liable for any loss, injury, damage, delay, or irregularity caused by the acts or omissions of these third-party providers.

Our total liability for any claim arising from your booking shall not exceed the total amount paid by you for the specific service in question.

9. Adventure Activities Disclaimer

Activities such as river rafting, bungee jumping, paragliding, trekking, and zip-lining involve inherent risks. By booking these activities, you acknowledge and accept these risks. You must follow all safety instructions provided by our guides and activity operators. Travel With Eshu is not liable for any injury, accident, or loss sustained during adventure activities.

10. Code of Conduct

We expect all our clients to behave respectfully towards local customs, fellow travelers, staff, and the environment. Any behavior that disrupts the experience for others or causes damage to property may result in termination of services without refund. You will be held financially responsible for any damage caused by your actions.

11. Photography and Marketing

We may take photographs or videos during tours for marketing and promotional purposes. By booking with us, you consent to the use of your images for such purposes unless you explicitly notify us otherwise in writing. We will never sell or misuse your images.

12. Privacy Policy

Your use of our website and services is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your personal information.

13. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Rishikesh, Uttarakhand, India.

14. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on this page. Your continued use of our services after any changes constitutes your acceptance of the revised terms.
